Prescriptive Easements


KGIC ditch easements are not always recorded in deeds or property records.  They are established by "historical use."  Colorado courts have upheld ditch company easements and the right to access those easements for the purposes of ditch maintenance or construction.

  • Divert water according to the Lateral Schedule
  • Return water to the Lateral at the end of your scheduled time
  • Non-shareholders are not entitled to water under any circumstances
  • Water rights transfers must be on the same lateral.
  • Shareholders may use only a pro rata or portion of free water
  • Gates should be placed in fences across ditch easements.
